Legislation holds GCs liable for specialty contractors’

unpaid wages and fringes

The Legislature is currently considering legislation that would make a general contractor liable for any unpaid wages and fringes of specialty contractors on all private construction projects. The bills are SSB 1395 and SB 5565. AGC is strongly opposed to this measure; members are encouraged to send their own Action Alert to legislators right away to oppose these bills. Recently, two AGC members traveled to Olympia to testify against it before the Senate Labor and Commerce Committee. “We are an ESOP—Employee Stock Ownership Plan company—100% employee owned,” said Dawn Stephens, CFO of Charter Construction and AGC second vice president. “Every decision that effects our company effects our people. I see this bill literally taking money from my employee’s retirement funds to foot the bill for someone else.” Read more...

State Senate passes revised bid-listing bill

Legislation that would alter the state’s bid-listing statute has been passed by the State Senate. The original version of the bill would have required a general contractor to list all specialty contractors at the time of bid. AGC strongly opposed that measure and was able to negotiate several improvements to the bill. The new version, ESB 5457, requires the listing of the structural-steel installation and rebar-installation contractors. It allows two days to list these contractors. The bill also makes a small change with regard to the current listing requirement for mechanical, electrical and plumbing contractors. Current law requires that these contractors be listed at time of bid “or within one hour;” this bill basically takes out the “or,” clarifying that the GC does indeed have the hour to list the mechanical, electrical and plumbing contractors. Excellence in Contract Administration award winners

Winners of the 2020 Partnership for Excellence in Contract Administration awards, co-sponsored by AGC and WSDOT, were announced at the AGC-WSDOT Annual Meeting on Jan. 9. These awards recognize and encourage extraordinary achievements by the contractor/WSDOT partnership responsible for delivering transportation projects in a timely, professional and responsive manner while also considering the needs of others affected by the project.
